Terms & Conditions

ALL TOURS:

Payment and Rates: Full payment is required at the time of booking. By phone at 780-732-7200 or online at www.youliveitup.ca. We accept   We accept Visa, Mastercard, debit or cash at the Live It Up Lifestyle Adventures Ltd. office located at 902, 11834 Kingsway Ave. Edmonton, AB, T5G 3J5. All rates are in Canadian Dollars (CAD).  There will be a 3% service charge to all credit card transactions.

Extra costs (unless otherwise specified): Meals, any equipment (if required), all transportation-related costs, National Park fees and other additional goods and services are not included in package prices, unless otherwise stated.

Live It Up Lifestyle Adventures reserves the right to review and confirm the details and prices on all tours and products. Rates and terms are subject to change without notice. We reserve the right to correct any errors, inaccuracies or omissions and to change or update information at any time, without prior notice (including after an order has been submitted or a tour has been booked). Such errors, inaccuracies or omissions may relate to product description, pricing, promotion and availability and we reserve the right to cancel or refuse any order placed or tour booked based on incorrect pricing or availability of information.

Trip Cancellation: Live It Up Lifestyle Adventures Ltd. reserves the right to cancel a tour at any time. Should this occur, booked patrons will be contacted prior to departure and offered a reschedule or refund.

Damaged, Lost or Stolen Property: Live It Up Lifestyle Adventures accepts no responsibility for property loss or damage during a tour. Individual participants alone are responsible for their personal belongings, including ski and snowboard equipment.

Disclaimer: Live It Up Lifestyle Adventures accepts no responsibility for the actions of persons and/or companies supplying goods and/or services as part of the Package, complication or prolongation of the Package for any reason. Live It Up Lifestyle Adventures Ltd. is not responsible for clients participation in activities such as alpine skiing, snowboarding, adventure activities, whitewater rafting, horseback riding, hiking, road travel, consumption of alcohol, and other activities related to the tour organized by Live It Up Lifestyle Adventures Ltd., regardless of if the activities were booked through Live It Up Lifestyle Adventures or not, that could result in physical injury, paralysis, death, or damage to self, to property or to third parties.

Itineraries: Live It Up Lifestyle Adventures will attempt to follow provided trip itineraries as closely as possible. In some circumstances including but not limited to road closures or supplier error, Live It Up Lifestyle Adventures may need to modify the initial itinerary before or during the trip. All patrons will be advised of these changes with as much notice as possible. All itinerary times are approximations and are subject to change based on road conditions, weather, traffic, etc.

Force Majeure – Acts of God: A full refund or credit will be made available at the sole discretion of the company.

Force Majeure – Acts of Government: A full credit will be made available at the sole discretion of the company.


Live It Up Lifestyle Adventures is acting as an agent

Live it Up Lifestyle Adventures Ltd (LIULA) has assembled your tour using many different and independent suppliers. LIULA has no control over their operations, timeliness, etc. All suppliers are vetted by us and they carry adequate insurance for their activities/operations.

Should there be a failure to supply, LIULA will first negotiate with the supplier to find a remedy. Should this fail and litigation be necessary, you will need to approach the supplier directly.

Your requests for special requirements are forwarded to our suppliers and you will receive verification of their answer in your communication with us. However, should the supplier be unable to perform or you find the solution to be unsuitable once you arrive, the remedy will lie with the supplier directly.

Special terms and conditions

Each reservation is made in your name, in certain circumstances, there will be an additional term or condition added to the overall Terms and Conditions outlined here. You will be made aware of these terms in your final package. 

Several suppliers will ask for an in-person waiver signature. Failure to provide the waiver will result in forfeiture of the activity with no refund.

Your authority

You are at least 19 years of age (18 if in Alberta, and tour is in Alberta) and have legal authority to enter this agreement in accordance with all terms and conditions herein. Should you be booking for others you further warrant that you have authority on behalf of all others in your booking.

You MUST inform all persons in your booking that these terms and conditions apply to all Travel Services booked for them and will be binding upon them.

If you do not have the necessary authority to bind all in your party, your party members must contact LIULA directly. Minors may be booked only by parents or guardians attending the tour.

Accuracy

Live It Up Lifestyle Adventures makes every effort to ensure the information you receive is accurate and complete. However, there may be times that our description is misinterpreted or misunderstood. LIULA will produce a tour per the direction of our client. The client accepts the tour as meeting their requests.

Liability release and agreement not to sue

The separate Live It Up Lifestyle Adventure Waiver must be signed prior to departure. This will be considered the primary document relating to liability, loss or claims. Any conflict of agreement the Waiver will be considered first.

 

PACKAGES:

All Inclusive Price: Package prices are “per person” and include accommodation based on package and any activities or attractions listed in the package. Activities or attractions may include lift tickets, adventure activities, entrance fees, guides, shuttles, etc. In advertised prices, taxes may or may not be included in the price. The total amount owing prior to check out will always include any applicable taxes.

Room Availability: Room availability is not always guaranteed. It may take 72 hours or more to check availability and confirm the reservation via email.

Ski lift tickets: Where possible, lift tickets will be delivered to your accommodation. Live It Up Lifestyle Adventures relies on suppliers to fulfill lift ticket delivery. It may be necessary to pickup at the ski area with a voucher. In some cases, lift tickets will be mailed to customer prior to departure.

Attractions and Activities: Where possible, your desired time for each attraction or activity will be fulfilled. Requests for time cannot always be fulfilled, based on supplier availability and/or other circumstances beyond our control. Live It Up Lifestyle Adventures relies on suppliers to fulfill attractions and activities as described in your package and details can be subject to change.

Guest Requirements: All names of room guests must be on the reservation. Each room must contain at least one person age 18 or older (age 19 or older for accommodations in British Columbia, New Brunswick, Nova Scotia, Northwest Territories, Yukon and Nunavut).

Hotel Damage Deposit: Live It Up Lifestyle Adventures is not responsible for damage deposits. Each room requires a credit card holder with a valid card or a cash deposit when checking in.

Cancellation – Refunds: Cancellation policies are created by individual partners. Each tour will note refund policies on their page, as well as in the terms upon the final booking. When possible, Live It Up Lifestyle Adventures may offer, at best, a full refund given with a cancellation notice of at least 72 hours or more before departure day for individual non-group bookings. A cancellation with notice of less than 72 hours prior to departure offers no refund. Refunds are solely at the discretion of Live It Up Lifestyle Adventures and their suppliers.

Road, weather and activity conditions are acts of nature and totally beyond our control. Most attractions and activities run rain or shine. If a supplier cancels their attraction or activity, you will be notified and offered a refund or change of time/ date. Live It Up Lifestyle Adventures encourages clients to check weather conditions before departing, as conditions can change at very short notice. Changes – More Than 72 Hours Prior to Departure: Any change requests are noted on each tour page, as well as in the terms upon the final booking. At best, a tour can offer changes to be made free of charge up to 72 hours prior to departure. Changes may include date adjustment, name change, activity/lift ticket category change, etc. To make a change to your booking, contact us by phone or email. If changes made to the booking change the price (e.g. activity/lift ticket category change, hotel change, date change), then the price difference will need to be paid prior to the booking being completed.

Changes – Within 72 Hours to Departure: Any change requests are noted on each tour page, as well as in the terms upon the final booking. Any changes requests within 72 hours of departure are not guaranteed. Please contact us and we will do our best to accommodate your requests. Changes may include date adjustment, name change, activity/lift ticket category change, etc. To make a change to your booking, contact us by phone or email. If changes made to the booking change the price (e.g. activity/ lift ticket category change, hotel change, date change), then the price difference and/or change fee will need to be paid prior to the booking being completed.

PromoCode Credits: Live It Up Lifestyle Adventures may offer a credit for a cancelled tour in the form of a PromoCode. PromoCodes that are given for any reason must be used within the same season in which they were given, unless otherwise specified. The winter/ ski season runs from November to May. The summer season runs from May to October. Once issued, the PromoCode is the sole responsibility of the holder and Live It Up Lifestyle Adventures cannot replace it if lost or stolen. PromoCodes have no cash value.


ELABORATE/CUSTOM TOUR DEPOSITS AND PAYMENTS:

Elaborate custom tour deposit

In some instances it will be necessary to provide a deposit to build an elaborate tour. The deposit amount will be 20% of the balance, CDN/person. The deposit is non-refundable, however, can be transferred to other tours.

Initial Deposit all tours

A non-refundable deposit equal to 20% of the total cost of the tour.

Final Payment in Full

Your full and final payment must be received 45 days prior to departure. Once the payment is received it is non-refundable. Should your final payment not be made in time, your trip may be cancelled without notice.

Changes

Each traveller is allowed one free change to the Itinerary once the tour is booked. Additional changes may be subject to change fees of $50/person/change. Please note that suppliers may have their own change policies. They may not offer refunds for cancellations or permit date changes.

Cancellations by you

If you cancel some or all portions of your booking the cancellation terms set out below will apply. A cancellation will only be effective when we receive written confirmation that you choose to cancel.

If you cancel a trip:
(a) 21 days or more prior to departure, we will hold the deposit amount as a credit;
or
(b) 20 days or fewer prior to departure, we will hold 50% of the monies paid by you in connection with the booking as a credit and retain the remaining 50% of monies paid by you in connection with your booking.

Changes by Live It Up

LIULA reserves the right to cancel, change or substitute any Travel Services at our sole discretion. Some cases will require Travel Services to be cancelled or changed after contract is executed.

Insurance

Travel insurance is highly recommended for all our travellers.

Your inclusions

Please review the inclusions in your package carefully, anything outside the list cannot be presumed to be part of your package.

Physical restrictions

In order to provide a seamless trip LIULA must know of any physical or mobility restrictions at the outset of the planning. Late notification resulting in changes will be subject to change fees.

Your package

You will receive your package from LIULA 21 days prior to departure or earlier. You must review the package to ensure completeness and accuracy.

Severability

These Terms and Conditions shall be deemed severable. In the event that any provision of these Terms and Conditions is determined to be unenforceable or invalid, such provision shall nonetheless be enforced to the fullest extent permitted by applicable law, and such determination shall not affect the validity and enforceability of any other remaining provisions.

Arbitration

Any dispute, failure to agree or claim between the Parties arising out of or in connection with this agreement, or in respect of any legal relationship associated therewith or derived therefrom, will be finally resolved by arbitration under the applicable Rules of the Alberta International Commercial Arbitration Act, which Rules are deemed to be incorporated by reference into this clause. The tribunal will consist of one arbitrator appointed in accordance with the said Rules. Except for the appeal process under the AICAA Rules, the parties agree that they will not appeal any arbitration decision, or decision of an Appeal Tribunal, to any court. The seat/place of arbitration will be Edmonton, Alberta.

 

GROUPS:

Waiver: All persons will be required to read and sign a supplied waiver at check-in on the day of the tour. Persons under the age of 18 must have a Waiver form signed by their parent or guardian. Click here to download the Waiver form.

Refund Policy: Individual refunds will be offered for cancellations made 30 days prior to departure. Substitutions are allowed up to 72 hours prior to departure.

Delivery Policy: Live It Up Lifestyle Adventures Ltd. shall deliver tours based on the itineraries sent in the confirmation emails at the time of booking.

 

GIFT CERTIFICATES:

Gift Certificates are refundable to the original purchaser up to 14 days after purchase if unused and with original receipt. Gift Certificates do not expire and can be used towards Live It Up services for their stated value. If rates increase, the difference will need to be paid. Gift Certificates cannot be exchanged for cash or used to make a payment on a credit account. Once issued, the Gift Certificates is the sole responsibility of the holder and Live It Up Lifestyle Adventures cannot replace Gift Certificates if they are lost, stolen or misplaced by any other means. Gift Certificates that were not purchased (i.e. gift, prize, compensation) expire the same season in which they are issued, unless otherwise stated. Live It Up Lifestyle Adventures is not responsible for any Gift Certificates that were purchased from a third party.

Redemption: Gift Certificate code can be entered at the time of booking during checkout or when booking though our office. Only one code can be entered per person. Please call the office to combine multiple codes.  If your Gift Certificates doesn’t have a code call the office to redeem

Cancellations: If a Gift Certificates is used towards a trip which is then cancelled by the patron, the Gift Certificates will be reinstated for its original value, in accordance to the corresponding Live It Up Cancellation Policy.

Gift Certificates Credits: PromoCodes that are given as a trip credit must be used within the same season in which they were issued. The winter/ ski season runs from November to May. The summer season runs from May to October.

PromoCodes from Live It Up’s sister company (MagicBus Adventure Tours) cannot be redeemed towards Live It Up trips and vice versa.
